At FAKS, protecting your personal data is a priority.

When you use the faks.co website (hereinafter the "Site") and the Faks application (hereinafter the "Application"),we may collect personal data about you.

The purpose of this policy is to inform you about how we process this data in compliance with Regulation (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (hereinafter the "GDPR")

1. Who is the data controller?

The data controller is COMMANDES PHARMA, a société par actions simplifiée (simplified joint stock company) registered in the Paris Trade and Companies Register under no. 881 529 861, with its registered office at 40 rue de Provence 75009 PARIS (hereinafter referred to as "We"), when you use the Site and/or the Application, when you create your customer account or when you manage our contractual relationship.

On the other hand, when our pharmacy and laboratory customers use our services, we may process personal data in their name and on their behalf, particularly with regard to their own teams. In this case, our customers then act as data controllers in accordance with Article 4 of the RGPD and we act as a processor, as a service provider.

2. What data do we collect?

Personal data is data that can be used to identify an individual directly or by cross-referencing with other data.

We collect data relating to pharmacists and laboratory staff who use the Site and the Application.
This data falls into the following categories:

Identification data (in particular your surname, first name, email address, landline and mobile telephone number);

Data relating to your professional life (in particular the name and address of the pharmacy or laboratory where you work);

Data relating to orders placed with laboratories (photos of invoices and delivery notes);

● Data contained in exchanges between pharmacists and laboratories;

Mandatory data are indicated when you provide us with your data. They are marked with an asterisk and are necessary to provide you with our services.

The data is kept for the time necessary to process your demo or information request and is deleted once it has been processed.

If we ask you for proof of identity, we will only keep it for as long as it takes to verify your identity. Once the verification is complete, the proof of identity is deleted.

To compile statistics on the use of the Application

Our legitimate interest in improving our services and, in certain cases, in sharing these statistics with pharmacy groups in order to analyze the use made of the Application by their members.

Data is kept for a period of three years from the date of collection.

4. Who are the recipients of your data?

Your personal data will be accessible to:

(I) Our company's staff;
(II) Our subcontractors: hosting service provider, transactional email service provider, CRM tools, payment service provider;
(III) Our pharmacy partners, pharmacy groups and laboratories;
(IV) If necessary: public and private organizations, exclusively to meet our legal obligations.

5. Will your data be transferred outside the European Union?

Your data is kept and stored for the duration of the processing on the Heroku platform hosted on the servers of the company AWS, located in Ireland in the European Union.

In the context of the tools we use (see article on the recipients concerning our subcontractors), your data may be transferred outside the European Union. The transfer of your data in this context is secured by means of the following tools:

● either these data are transferred to a country that has been judged as offering an adequate level of protection by a decision of the European Commission;

● or we have concluded with our subcontractors a specific contract framing the transfers of your data outside the European Union, based on the standard contractual clauses between a data controller and a subcontractor approved by the European Commission;

● or we have recourse to the appropriate safeguards provided for by the applicable regulations.

6. What are your rights to your data?

You have the following rights with regard to your personal data:

- Right to information: this is the reason why we have drawn up this policy. This right is provided for in articles 13 and 14 of the RGPD.

- Right of access: you have the right to access all your personal data at any time, in accordance with Article 15 of the GDPR.

- Right of rectification: you have the right to rectify at any time your inaccurate, incomplete or obsolete personal data in accordance with Article 16 of the GDPR

- Right to limitation: you have the right to obtain the limitation of the processing of your personal data in certain cases defined in Article 18 of the GDPR.

- Right to erasure: you have the right to demand that your personal data be erased, and to prohibit any future collection for the reasons set out in Article 17 of the GDPR

- Right to lodge a complaint with a competent supervisory authority (in France, the CNIL), if you consider that the processing of your personal data constitutes a violation of the applicable texts. (Article 77 of the RGPD)

- Right to define directives concerning the conservation, deletion and communication of your personal data after your death, in accordance with Article 40-1 of the French Data Protection Act.

- Right to withdraw your consent at any time: for purposes based on consent, Article 7 of the GDPR provides that you may withdraw your consent at any time. This withdrawal will not affect the lawfulness of the processing carried out before the withdrawal.

- Right to portability: under certain conditions specified in Article 20 of the GDPR, you have the right to receive the personal data you have provided to us in a standard machine-readable format and to require its transfer to the recipient of your choice.

- Right to object: under Article 21 of the GDPR, you have the right to object to the processing of your personal data. Please note, however, that we may continue to process your personal data despite this objection, for legitimate reasons or to defend legal rights.
